Flight delayed or cancelled? You may be owed compensation

Under EU261 (EU carriers + EU departures like LHR is not but JNB→FRA on Lufthansa is), UK261 (LHR/LGW arrivals on BA, Virgin), Saudi GACA (for Saudia, Flynas on Hajj/Umrah routes), and Canada APPR (Africa-Canada diaspora flights), passengers can claim up to €600 from the airline for 3+ hour delays, cancellations, or denied boarding. AirHelp checks eligibility free and files the claim on your behalf.

Hajj & Umrah Flight Disruption: GACA Compensation Rights for African Pilgrims

For the estimated 35,000+ African Hajj pilgrims annually (Nigeria 35,000, South Africa 2,500, Kenya 4,000, Ghana 6,500) plus year-round Umrah pilgrims numbering in the hundreds of thousands, flight disruption on the African → Jeddah corridor is consequential. Lost days mean lost ihram timings, missed Tawaf windows, contract complications with Hajj operators. Saudi Arabia’s General Authority of Civil Aviation (GACA) has a passenger-compensation framework that applies to flights operated by Saudi-licensed carriers regardless of origin. This guide explains what is compensable for African pilgrims.

TL;DR: Scheduled Saudia (SV), Flynas (XY), Flyadeal (F3) flights from African origins to JED: 4+ hour arrival delay = SAR 2,500 long-haul / SAR 1,500 medium-haul per pilgrim under GACA Consumer Protection Regulations. LOS-JED ~5,500 km long-haul → SAR 2,500. CAI-JED ~1,400 km medium → SAR 1,500. JNB-JED ~6,800 km long-haul → SAR 2,500. Cancellation <14 days notice + denied boarding trigger same. Dedicated Hajj charters via NAHCON/SAHUC/KAHCON/GHC: first claim path is the Hajj board, not airline. Limitation: 1 year safe.

Scheduled flight vs Hajj charter — critical distinction {#scheduled-vs-charter}

This distinction determines your claim path:

Scheduled flight (regular IATA service):

  • Flight number is standard (SV, XY, ET, KQ, etc.) and bookable on the airline website
  • Your contract is directly with the airline
  • GACA applies (if Saudi carrier) — claim direct to airline + escalate to GACA
  • AirHelp can handle the case end-to-end

Hajj charter (dedicated pilgrim group flights):

  • Operated under contract between Hajj board (NAHCON, SAHUC, KAHCON, GHC) and airline
  • Your passenger contract is with the Hajj board and licensed tour operator, not directly with the airline
  • First claim path: Hajj board liaison office, not the airline directly
  • Even if delay is technically GACA-covered (Saudi carrier), the legal pathway runs through the Hajj board
  • AirHelp’s automated systems are not configured for charter operations

How to tell: look at your ticket. Standard IATA flight number → scheduled. “Hajj 2026 Charter X” labelling → charter.

Filing GACA claim from Lagos, Johannesburg, Cairo, Nairobi {#filing}

For scheduled Saudia or Flynas flights:

  1. At the airport: boarding pass photo, gate-display photo showing delay/cancellation, written notice of cause if obtainable, all receipts.
  2. Within 7 days: file at saudia.com/passenger-rights (English) or flynas.com/contact. Upload documents, provide international wire bank details (NGN, ZAR, EGP, KES — or USD intermediary).
  3. Wait 30 days for response.
  4. If refused or no response: escalate to GACA Passenger Rights Department at gaca.gov.sa/web/en/services/passenger-rights.
  5. For pilgrims unable to navigate Arabic/English portal: consular support is limited; AirHelp’s regional team handles GACA filings.

Limitation period: 1-3 years under Saudi civil law for contract claims. Safe: file within 1 year.

Hajj board escalation: NAHCON, SAHUC, KAHCON, GHC {#hajj-boards}

For Hajj charter passengers, the Hajj board is the first-claim point:

  • NAHCON (Nigeria): nahcon.gov.ng — National Hajj Commission
  • SAHUC (South Africa): sahuc.org.za — South African Hajj & Umrah Council
  • KAHCON (Kenya): Kenya Hajj Commission
  • GHC (Ghana): Ghana Hajj Committee — under Ministry of Inner-City and Zongo Development
  • MUMA (Mindanao Hajj liaison, also serves African pilgrims via Saudi Hajj Ministry): secondary path

The Hajj board can: (a) escalate to the Saudi Hajj Ministry, (b) negotiate with the operating carrier under their contract, (c) provide refunds or rebookings from group budget. They typically cannot enforce GACA monetary compensation directly — that requires direct passenger-to-carrier engagement under Saudi law.

FAQ {#faq}

Is my African Hajj or Umrah flight to Jeddah covered by Saudi GACA?

If operated by Saudia, Flynas, or Flyadeal — yes. 4+ hour arrival delay on long-haul (LOS, JNB, ACC, DAR, KGL, CPT to JED) → SAR 2,500 per pilgrim. Medium-haul (CAI, ADD, NBO, MBA to JED) → SAR 1,500.

How much GACA compensation for African long-haul to Jeddah?

SAR 2,500 (~USD 670) for long-haul 4+ hour delay or cancellation <14 days notice. Group of 30 pilgrims from JNB: SAR 75,000 (~USD 20,000) total.

What about Hajj charter flights run through the Hajj boards?

Charter contracts are with the Hajj board + tour operator. First claim path: Hajj board liaison, not airline. GACA still applies technically but legal pathway runs through the board.

How do I file a GACA claim from Africa?

Saudia portal saudia.com/passenger-rights (English/Arabic). Upload boarding pass, gate-display photo, receipts, international wire details. Wait 30 days. Escalate to GACA if refused.

Does the African Union have any equivalent regulation?

No fixed compensation. SACAA, NCAA, KCAA, GCAA have right-to-care provisions but no EU261-equivalent statutory amounts. SAATM (Single African Air Transport Market) is harmonizing rules but compensation remains national.
